Continuing Resolution, Debt Ceiling
Need to be Addressed
The nonpartisan Congressional Budget Office (CBO) warned Tuesday that the long-term outlook for the national debt remains dire, despite a near-term drop in the deficit that has been lauded by the Obama administration.

Federal debt held by the public is slated to rise from 73 percent of the economy in 2013 to 100 percent of gross domestic product by 2038, the CBO said.

Many economists have warned that if debt held by the public approaches 100 percent of the GDP, it can bring on the kind of fiscal crises seen recently in European countries.

The long-term increase occurs mostly in the out years. The budget deficit this year is expected to be $642 billion, a drop from the $1.1 trillion deficit in 2012. The decline will continue through 2015, the CBO said.

“The unsustainable nature of the federal government’s current tax and spending policies presents lawmakers and the public with difficult choices,” the CBO says in its new report. “Unless substantial changes are made to the major health care programs and Social Security, those programs will absorb a much larger share of the economy’s total output in the future than they have in the past.”

A $103,000 Dunham Fund grant to the Kaneland Foundation will provide the Fox Valley Career Center with the start-up funds to purchase equipment and curricular supplies, improve infrastructure, and train instructors for a Project Lead the Way pre engineering program.

Starting this October, Rebuilding Together Aurora will be assisting Sear’s Heroes at Home Program with several critical home repairs to improve the lives of the military and their families through extensive home rehabilitations.

The Heritage Hall of Honor will recognize partners in the community who have made a significant impact and contribution to Naper Settlement and Naperville Heritage Society. The presentation will be held at 2:00 p.m. Sunday, October 6 at Naper Settlement.

Marketplace Notices: To Comply or Not to Comply?

The deadline for employers to provide current employees with notice of health care coverage options available through the ACA Marketplace is October 1, 2013 – right around the corner.

      The DOL has published model notices that employers can use to comply with the notice requirements:
§  Model Notice for employers who offer a health plan to some or all employees

§  Model Notice for employers who do not offer a health plan

 

On September 11, 2013, the DOL published FAQ’s confirming that there is no penalty tied to the Marketplace Notice requirement.  As this particular notice requirement was done as an amendment to the FLSA (instead of as an amendment to HIPAA or ERISA), the FAQ’s should not have been a surprise or considered as a drastic change in position by the Department.

In light of the recently published FAQ’s, some are now advising employers not to publish the notices at all.  While there is not a penalty tied to the notice, employers should not forget that they are still legally required.  With the DOL increasing its scrutiny of welfare plans (and where such audits often consist of reviews to ensure proper plan documentation and these very type of notices are in place), it is not recommended to blatantly disregard the Marketplace Notice requirement.

Instead, the confirmation of lack of penalty should simply be referred to as a reminder to not spend too much time or analysis on this Notice requirement.  In other words, just do your best to comply.  In addition, many employers that are getting caught up with the particulars of how to complete part B of the model notice and having difficulty completing it are simply distributing part A of the Notice.  There are various considerations to take into account if you are considering this strategy and whether it is best for your company.  In that event, you may want to contact counsel for advice on the best options for your situation.  Keep in mind that when employers are eventually subjected to penalty exposure in 2015, that penalty exposure will be tied to whether or not a person accesses a subsidy at the Marketplace.  Whether a person can access a subsidy is dependent on the price and availability of the employer offering.   All of that information is to be included on Part B of the model notice.  Thus, without providing that information to an employee, the employee may very likely give inaccurate information at the Marketplace resulting in an inappropriate subsidy award, which in turn increases potential penalty exposure for the employer.

Also, remember that the Notice requirement is not over after you meet your October 1, 2013 distribution date.  Employers must also provide new employees with notice of health care coverage options available through the ACA Exchange “at the time of hiring.”  For 2014, the DOL will consider an employer to have given notice “at the time of hiring,” if the notice is provided within fourteen (14) days of the new employee’s start date.

VNA Health Care will receive nearly $1.2 million through three different grants to help people enroll in Medicaid or obtain insurance through the Illinois Health Insurance Marketplace. The funding comes from the Health Resources and Services Administration outreach and enrollment grant, the state In-Person Counselor grant, and the Federal Navigator grant.

Legislative Relations Update
Congressman Randy Hultgren

Last week, Congressman Randy Hultgren visited with more than 40 business representatives at Alarm Detection Systems. Dominant themes of the conversation centered on Affordable Care Act: It appears there is growing support for delaying – if not defunding it to start over; Continuing Resolution: Discussions and action to continue funding after the current fiscal year ends September 30; Debt Ceiling; and Immigration Reform.

In addition, State Rep. Stephanie Kifowit joined DCEO Director Adam Pollet and business leaders on Wednesday. Discussion included DCEO programs that could benefit local businesses.

Numerous news articles have been written on the developments with pension reform. No agreements have been reached, but there seems to be discussion.

Rep. Jim Durkin of Western Springs was elected yesterday to lead the House GOP caucus on Sept. 20 after Rep. Tom Cross announced he was stepping aside as leader as Cross is expected to announce a run for State Treasurer.
